Terms of service

Some clauses below are marked [TODO]. Those are decisions that have not been made and have not been reviewed by a lawyer. They are left visible rather than filled with plausible-sounding text.

1. Who you are agreeing with

These terms are an agreement between you and Kismet Software LLC, a Utah limited liability company doing business as Tüük (“we”, “us”). By creating an account or using the app you accept them and our privacy policy.

2. What Tüük does

Tüük keeps a household's shopping lists, pantry, coupons, meal plans, calendar, chores, budget, and receipts in one shared place, and lets you add products by photographing them.

Prices, deals, and extracted product details are best-effort. They come from photos, from shops, and from other households, and they go out of date. Check the shelf, not the app, before you rely on a price.

3. Your household

Whoever you invite into your household can see and change everything in it — that is what a shared household is. Invite accordingly. You are responsible for what happens under your account, and for keeping your password to yourself.

Accounts are for adults. See the children section of the privacy policy.

4. What you contribute

Your household's own data stays yours and stays private.

When you photograph a product, you grant us permission to extract the product details and add them to the shared product catalog described in the privacy policy — what the product is, what it cost, and which shop it was in. That contribution carries no reference to you, and it is what makes the catalog worth having for everyone including you.

Do not photograph things you have no right to photograph, and do not upload anything unlawful.

5. Cost

Creating an account and running your household is free today. [TODO: decide whether any part of Tüük becomes paid, and set the terms for it before it does.]

6. Acceptable use

Do not attack the service, scrape it, work around its limits, or use it to harvest the catalog wholesale. Do not use it to break the law.

7. Availability

Tüük is early software. We try to keep it up and we do not promise it will be, and features may change or be withdrawn. Keep anything you would be upset to lose somewhere else as well.

8. Warranties and liability

The app is provided “as is”. We do not warrant that prices, product details, deals, or extracted receipt data are accurate — see clause 2. [TODO: liability cap and indemnity. Needs counsel.]

9. Ending it

You can delete your household whenever you like, and that deletes its data as described in the privacy policy. We may close an account for a serious or repeated breach of these terms.

10. Governing law

These terms are governed by the laws of the State of Utah, and disputes will be heard in the state or federal courts of Salt Lake County, Utah — Kismet Software LLC is a Utah limited liability company. [TODO: decide whether to add arbitration / a class-action waiver.]
